IRS goes after eBay sellers

San Jose, California — As the April 15 deadline for U.S. private citizens to file their 2004 income tax returns draws near, the government is reminding sellers on eBay that they may have to report any proceeds from sales on the auction site as taxable income.

This could be a surprise to some of the 135 million registered eBay users who consider trading on San Jose-based auction site to be a non-taxable hobby. Complicating matters, eBay says it doesn’t report individual sales figures to the government – users are responsible to report any profits on their own tax returns.

The amount of money traveling through eBay is big business. $33.8 billion worth of merchandise was sold on the site in 2004, up from $5.2 billion in 2000.

Although eBay pays taxes on its share of the sales (5.25 percent cut from each transaction as of Feb. 18), the IRS fears some small businesses are using the site to dodge tax responsibility. Adding to the confusion, some sellers may legally be a taxable business without realizing it.

The U.S. Internal Revenue Service has a nine-point checklist it uses to determine whether or not a money-making activity is legally a business, which means money made is taxable, or a simple hobby – where it is not taxable. The IRS can consider a person to be a legal “business” even though they never incorporated or claimed to be one.

According to Woodbury, New York-based accountant Bart Fooden in an Associated Press interview, the IRS looks for such things as evidence that the auction seller depends on the eBay sales income to pay for activities other than maintaining the hobby, acts in a businesslike manner when selling on auctions or puts enough time and effort into the eBay activities that there is an obvious intent to make a profit.

But Fooden said in the same interview casual users probably have nothing to worry about. Those cleaning out closets or the garage and selling off junk for less than the original price paid are not turning a profit, so that money is not considered income and is not taxable.

A London man charged on Sunday with drugging and murdering four men made his first court appearance yesterday. Stephen Port, 40, was remanded to appear before a higher court tomorrow.

Port faces four counts of murder and four counts of “administering a poison with intent to endanger life or inflict grievous bodily harm”. He is alleged to have administered overdoses of recreational drug GHB. He allegedly murdered the men at his home before dumping the bodies, after finding victims online using gay dating services.

Three of the deaths were last year. Anthony Patrick Walgate, 23, was found dead on June 19, 2014 in Cooke Street. Port lives in Cooke Street. The other three alleged victims were found in the vicinity of St Margaret’s Church on North Street. Gabriel Kovari, 22, was discovered dead on August 28. Daniel Whitworth, 21, was found dead the following month on September 20. Fourth alleged victim Jack Taylor, 25, was found a year later on September 14.

Whitworth and Kovari were known to each other, according to testimony at inquest. The Metropolitan Police has referred itself to the Independent Police Complaints Commission concerning what police called “potential vulnerabilities in [our response] to the four deaths.” Police did not initially link the deaths.

Special needs teacher Port, who was guarded by three officers in the dock, spoke in court to confirm his identity. He did not indicate if he will deny the offences. He was arrested following a police appeal to trace a man seen with Taylor shortly before his death.

Police at the time released security footage of Taylor’s movements, with an officer telling the press “the man captured on CCTV may well be the last person to talk to Jack.” The four deaths were finally linked and passed to the Metropolitan Police’s serious crime investigators on Wednesday last week.

The Magistrates’ Court ordered Taylor to appear at the Old Bailey, a famed London courthouse, tomorrow. He spent the hearing holding one arm, and repeatedly looking at the floor, whilst clad in a grey tracksuit given to him by the authorities holding him.

A robotic system at Stanford Medical Center was used to perform a laparoscopic gastric bypass surgery successfully with a theoretically similar rate of complications to that seen in standard operations. However, as there were only 10 people in the experimental group (and another 10 in the control group), this is not a statistically significant sample.

If this surgical procedure is as successful in large-scale studies, it may lead the way for the use of robotic surgery in even more delicate procedures, such as heart surgery. Note that this is not a fully automated system, as a human doctor controls the operation via remote control. Laparoscopic gastric bypass surgery is a treatment for obesity.

There were concerns that doctors, in the future, might only be trained in the remote control procedure. Ronald G. Latimer, M.D., of Santa Barbara, CA, warned “The fact that surgeons may have to open the patient or might actually need to revert to standard laparoscopic techniques demands that this basic training be a requirement before a robot is purchased. Robots do malfunction, so a backup system is imperative. We should not be seduced to buy this instrument to train surgeons if they are not able to do the primary operations themselves.”

There are precedents for just such a problem occurring. A previous “new technology”, the electrocardiogram (ECG), has lead to a lack of basic education on the older technology, the stethoscope. As a result, many heart conditions now go undiagnosed, especially in children and others who rarely undergo an ECG procedure.

Buffalo, New York —A three alarm fire at a house owned by John and Evelyn Bencinich, two of the initiators of a lawsuit filed against the Elmwood Village Hotel proposal in Buffalo, required firefighters to rescue eight cats and two dogs in Buffalo, New York today.

At about 8:30 (eastern time) firefighters were called to the home on 48 Granger Place to put out a fire that had started in the basement. It quickly spread to the first floor where the main bathroom was destroyed. The fire did not spread to the second floor or attic.

Initial calls said that many animals were inside the house and firefighters quickly worked to rescue all the cats and dogs. At least one cat and one dog had to receive CPR and oxygen, but both are reported to be in stable condition. At least 3 cats are unaccounted for, but after a search of the house, the cats were not believed to have been inside at the time the fire started.

One elderly woman, Anna Bencinich, the mother of Evelyn, was rescued by neighbors who helped her from the burning house.

“There was smoke all over the house. The fire started in the basement and spread to a small portion of the first floor. Two firefighters were injured while fighting the fire and were transported to Erie County Medical Center,” said Division Fire Chief Thomas Ashe who also said that sections of the kitchen wall at the back of the house had to be torn out to stop the fire from spreading through the walls.

One firefighter is being treated for bite injuries to his face that he received while attempting to rescue a dog. The other firefighter was treated for injuries he received to his hand, which was believed to have been caused by glass or a cat scratching him. The names of the injured firefighters are not known. The injuries are said to not be life threatening.

According to witness reports, the home owners had a new water heater installed just last week, but it is not known if the fire was caused by the heater.

“We believe the fire was caused by an electrical (malfunction). An investigation is being conducted,” said Battalion Chief Joe Fahey who also added that they did not believe arson was the cause.

Russian President Vladimir Putin spoke live on state television Monday in his annual state-of-the-nation address using high ideological rhetoric when calling on lawmakers and the public to strengthen democracy and the rule of law. His 50 minute address from the Kremlin’s Marble Hall only briefly touched on the “epidemic of collapse” , a reference to upheavals in Chechnya, Kyrgyzstan and the Ukraine, which was “a real drama” stranding millions of Russians beyond the borders of the Russian Federation.

Brushing off what was probably taken as criticism during last week’s visit by Condoleezza Rice who commented the Kremlin ran a “managed democracy”, Putin stressed that “Russia … will decide for itself the pace, terms and conditions of moving towards democracy.”

Putin was critical of the lack of progress in implementing his reform proposals. Calling for a crackdown on corruption, where treatment by tax inspectors are “terrorizing business”, he addressed concerns of the business community by condemning a series of back-tax bills like the ones that dismembered Yukos and face other major Russian corporations.

He was also critical of a bureaucratic attitudes that treat “state service as some type of business”. He made clear the need for investment must be met by “rules of the game” that are consistent, saying “Russia is certainly interested in the inflow of private investments on a large scale, including foreign investments. It is our strategic choice and our strategic approach.”

Putin called for proposals to index wages to inflation over the next two years, and for the introduction of a flat 13% tax on undeclared earnings in the shadow economy, a slice that represents nearly 35% of the nation’s economy, by legalizing what was previously defined as illegal income.

Putin supports the development of a strong state system with determination for Russia to avoid the disarray that led to the collapse of the Soviet Union. Saying, “First and foremost it is worth acknowledging that the demise of the Soviet Union was the greatest geopolitical catastrophe of the century.” He sees the need for strengthening the legal system and the political environment to assure a more just society in avoiding a replay of a Russian downfall.

On politics, he pointedly abandoned the much-used ‘stability’ catch phrase of the bureaucracy. Putin signaled to the bureaucratic caste who are on the eve of their upcoming parliamentary and presidential elections they should promote partisanship and civil society.

By studiously avoiding too many references to business, the thrust of his address sought to reassure the small property holder class, rather than big business and other elite investors.

Cars drove home the big prize last night, from the 34th Annual Annie Awards. The animation industry’s highest honor, ASIFA-Hollywood’s Annies recognise contributions to animation, writing, directing, storyboarding, voice acting, composing, and much more.

As mentioned, Pixar took home the big prize last night, after facing stiff competition from four other Happy Feet, Monster House, Open Season, and Over the Hedge.

But the biggest winner of the night didn’t get a “Best Animated Feature” nod at all. Flushed Away won five feature animation categories including Animated Effects (Scott Cegielski), Character Animation (Gabe Hordos), Production Design (Pierre-Olivier Vincent), Voice Acting (Sir Ian McKellan as Toad), Writing (Dick Clement, Ian La Frenais, Chris Lloyd, Joe Keenan, and Will Davies).

Over The Hedge won awards for Directing (Tim Johnson and Karey Kirkpatrick), Storyboarding (Gary Graham), and Character Design (Nicolas Marlet).

Of little surprise, Randy Newman won an Annie for Cars in the “Music in an Animated Feature Production” category. Newman has won many Oscars for his movie music, and has a nomination this year for the song “Our Town”. Newman didn’t attend the Annies, instead picking up a Grammy for “Best Song Written For Motion Picture, Television Or Other Visual Media”.

DisneyToon Studios’ Bambi II won “Best Home Entertainment Production”, while “Best Animated Short Subject” went to Blue Sky Studios’ No Time For Nuts, which is based on Ice Age.

“Best Animated Video Game” went to Flushed Away The Game, while a United Airlines ad named “Dragon” won a “Best Animated Television Commercial” Annie for DUCK Studios.
